California Judges Panel

Description:
A distinguished panel of California Judges will participate in a one-hour question/answer session about what they see as some of the best practices for receivers and attorneys. Learn from a judicial perspective as to the dos and don’ts to enhance your practice. What pre-filing considerations should be made to maximize your chances of getting a receiver appointed? What pitfalls can be avoided by receivers to maximize your chances of successfully navigating a receivership estate? Does the receiver have any "inherent" powers that do not need to be spelled out in the Appointment Order, or is it better to spell out every one of the receiver’s powers, duties, and responsibilities in the Appointment Order? What considerations go into allowing the Receiver the authority to market and sell a real or personal property? You’ll also have an opportunity to ask questions of the panel during this "don’t miss" presentation.

Judge Jury, has served over 20 years as a Bankruptcy Judge presiding over thousand of bankruptcy proceedings. She has also served as a member of the United States Bankruptcy Appellate Panel for the Ninth Circuit. Prior to taking the bench, she had over 21 years of experience as a litigator primarily practicing in bankruptcy. She was the first female associate and partner at Best, Best, Krieger, a professional law firm in Los Angeles, California. She now actively serves her community with extensive pro bono work.

Oren Bitan, Esq.

Oren Bitan has an extensive legal background that includes business, real estate, banking, receivership, consumer product, and commercial litigation.  Mr. Bitan is known for his ability to solve complex business disputes for his clients in a strong but practical manner.  He is a trusted advisor who guides his clients through their day-to-day legal concerns, and has particular expertise in matters involving real estate, banking and lending, creditors’ rights, wine, beer, liquor, cannabis, and intellectual property.

Representative clients include banks and financial institutions, private lenders, state and federal receivers, private investors and investment funds, private equity groups, real property developers, breweries, wineries, distilleries, cannabis businesses, consumer products companies, and corporate entities large and small.

Robert Mosier, Esq.

Robert P. Mosier is President and Chief Executive Officer of Mosier & Company. His specialty for the past forty-plus years has been turnarounds and dissolutions. For the past thirty-six years, these skills have been applied as a Court-appointed fiduciary in State and Federal Court and Federal Bankruptcy Court.

Total Court/fiduciary assignments since 1985 exceed 645 cases. In April 2009, Mr. Mosier was appointed as a Federal Equity Receiver to oversee the shutdown and windup of Private Equities Management Group (PEMG). The appointment was made in response to an SEC complaint in the United States District Court in Los Angeles. The SEC complaint alleges fraud and Ponzi-like management of approximately $1 billion worth of investment. The major investors included six banks in Taiwan.
